Compensation, Benefits and Employment

Andreas Mauroschat heads the employment and pension law practice in Germany. He advises national and international clients on all related aspects of M&A and outsourcing transactions and corporate re-structuring measures.

He regularly advises clients in all matters of the individual and collective employment law. A prominent element of his practice was advising several leading German and international banks on implementing international remuneration systems under the new EU rules for the remuneration systems of financial institutions and insurances.

Mr. Mauroschat's employment litigation and dispute resolution experience includes advising international clients in settling highly sensitive disputes with top level executives involving various jurisdictions. He also represented clients in the resolution of disputes with public authorities relating to social security matters. Further significant cases related to disputes arising from stock option plans and pension schemes of international clients.

Privacy, Data Security and Information Management

A major element of Mr. Mauroschat's practice is advising German and international clients on data privacy compliance, data security and cross-border data transfers. He has advised several public companies on setting up a practical multinational shared service center structure in compliance with EU data privacy law. His experience also includes implementing group-wide privacy and data security policies and assisting clients in investigations of breaches of data security and related communication with the data privacy supervisors.

Corporate Governance and Compliance

Mr. Mauroschat advises corporate boards and committees on a wide variety of corporate governance matters, including corporate responsibility and fiduciary duties, rules and procedures of corporate bodies and regulatory disclosure matters. He also advises clients on legal compliance matters, in particular in the sensitive areas of employment law, data privacy, executive compensation and internal controls and investigations. Mr. Mauroschat frequently holds compliance seminars and training sessions for clients.

  • Representation of an international airline in a series of labour court disputes with employees in connection with a transfer of business.
  • Representation of an international telecommunication company in a series of court cases relating to a stock option scheme.
  • Advising a US public company on data privacy and compliance issues in connection with a major internal investigation.
  • Advising a public German company on the EU-wide roll-out of a new personnel information and management system.
  • Advising a public US chemical company on setting up a multinational shared service center structure in compliance with EU data privacy law.
