New York Inches (Slowly) Closer to Allowing Marcellus and Utica Shale Hydrofracking with Release of Revised Draft Supplemental Generic Environmental Impact Statement
On September 7, 2011, the New York State Department of Environmental Conservation (“NYSDEC”) issued its revised draft Supplemental Generic Environmental Impact Statement (“Revised Draft SGEIS”) on high-volume hydraulic fracturing (commonly referred to as hydrofracking). The Revised Draft SGEIS includes NYSDEC’s recommendations on mitigating the environmental impacts of hydrofracking and updates the preliminary Revised Draft SGEIS that was released by NYSDEC in early July 2011 primarily by including an analysis of the socio-economic impacts and community and local impacts associated with hydrofracking. NYSDEC is accepting public comments on the Revised Draft SGEIS through December 12, 2011.
