David J. Waldron
Partner
David Waldron is (Non-US) Co-Chair of the firm's Litigation Department and is also Co-Chair of the firm's Energy Litigation Practice Group. He is a solicitor advocate and has a broad based international commercial disputes practice. David is an accredited mediator.
David has particular experience in disputes concerning the international oil, gas and energy industries, large projects (industrial, heavy engineering and infrastructure), financial products (private equity, derivatives and risk transfer), general commercial disputes (supply agreements, sale agreements and joint ventures) and business restructuring.
A large part of David's practice is heard in arbitrations. In recent times he has dealt with arbitrations principally heard in London and in Paris. David has experience of ICC, LCIA and ad hoc arbitrations.
David has significant experience in conducting disputes in the High Court of England & Wales, the Court of Appeal and the House of Lords. In addition, he regularly conducts and manages cross-border disputes, which recently have taken place in such jurisdictions as Belgium, Australia, Jamaica, Germany, Ghana, Equitorial Guinea, Cayman, Bermuda, Ukraine and Russia.
David is very experienced in international e-discovery issues.
Selected Representations
David is often brought in at an early stage to provide his clients with an early resolution to their dispute, these matters are regularly settled through negotiation and mediation. In addition, many of David's cases are arbitrations, the exact details of which are confidential. Similarly, many of David's clients prefer that he treat their representations with appropriate sensitivity. Therefore the selected representations are anonymised.
Agribusiness
- Advising agribusiness in its claim for damages (arbitration) arising out of a major construction project
Bank
- Instructed by the client to seek recovery of the losses sustained to their treasury portfolio because of a ratings agency downgrade
Insurance Co
- Advising insurance Co regarding contesting a scheme of arrangement, and information to which it is entitled
Oil Co
- Representing oil Co in an arbitration claim for damages for claims of breach of contract and tort arising out of a gas supply contract
- Representing oil Co in defending a claim through a joint venture by the providers of seismic services
- Advising oil Co in defending a claim, in arbitration, from a shareholder/ joint venture partner, regarding duties arising in the company/joint venture
Pension Co
- Advising pension Co regarding trades conducted by its fund managers, leading to significant trading losses
Power Co
- Representing power provider in High Court proceedings regarding ownership of CO2 emission credits
Seismic Co
- Representing Seismic Co in an arbitration from an agent for contractual damages regarding development of business in predefined geographic area
